(11) The Contracting Parties conclude an agreement under which nationals of a State who are convicted by the courts of the other State and who do not reside there may choose to serve their sentence in their State where they are nationals. 1. The Treaty shall be subject to ratification in accordance with the constitutional procedures of both Parties. The instruments of ratification of this Treaty shall be exchanged in Panama at the same time as the exchange of the instruments of ratification of the Treaty of Permanent Neutrality and Operation of the Panama Canal, signed on that day. This Treaty shall enter into force at the same time as the Treaty of Permanent Neutrality and Operation of the Panama Canal six calendar months after the exchange of instruments of ratification. The entire territory of the Republic of Panama, including the territories that the Republic of Panama places at the disposal of the United States of America in accordance with this Treaty and the related agreements, shall be under the flag of the Republic of Panama and, therefore, that flag shall always occupy the position of honour. 2. The flag of the United States of America may be presented with the flag of the Republic of Panama at the seat of the Panama Canal Commission, at the seat of the Joint Committee and in accordance with the Agreement implementing Article IV of this Treaty. (h) the exercise of another right granted under this Treaty or otherwise agreed between the two Parties.
